Nursing Home Abuse & Neglect

More and more Americans rely on nursing home personnel to help them lead peaceful and comfortable lives in their later years. Nursing home residents are often among the most vulnerable members of society, completely dependent on their caretakers. Because of this reality, both federal and state laws and regulations have been enacted to protect nursing home residents from abuse and neglect.

If you suspect that someone you love has been injured as a result of abuse or neglect in a nursing home, whether in Blount County or elsewhere in Tennessee, you should discuss the situation with an experienced personal injury attorney. Unfortunately, many nursing home residents can’t speak up or otherwise act to protect themselves.

Nursing home abuse may be physical or psychological; it may also be financial. Signs that a nursing home resident may be abused or neglected include

  • Untreated bedsores
  • Sudden unexplained weight loss
  • Malnutrition or dehydration
  • Unhygienic living conditions (whether related to the resident’s personal hygiene or the hygiene of the nursing home overall)
  • Unexplained, sudden changes in personality or behavior.

According to the Tennessee’s Department of Health’s most recent report to the Tennessee General Assembly, 325 nursing homes were licensed to operate in Tennessee in 2009. Nineteen of them were cited that year for providing a substandard level of care defined as “Immediate Jeopardy.” Admissions at 12 Tennessee nursing homes were suspended in 2009, following complaints. The Tennessee Department of Health website provides extended information about Tennessee nursing homes.

Mark: We would like to thank you for all the hard work you put in winning our medical malpractice lawsuit. The money we were awarded will certainly change our lives. The fact that you never treated us like clients but instead like friends meant so much to us. Again from our hearts we say thank you.

The Peroulas family and I deeply appreciate your help and expertise. Although I am certain that it would have been most enjoyable to work with you on the trial, my clients are happy with what they and I believe to be a very favorable settlement, thanks in large part to your guidance.

We appreciate the great job that you did on our case. You watched out for our interest even before you took our case. Mark Hartsoe did a wonderful job. He showed great expertise as he went up against a multi-national corporation with multiple lawyers. He had a thorough understanding of the many details and events that occurred. We were especially impressed with his skill during mediation. Mark’s PowerPoint presentation was excellent, overwhelming the opposition. It was refreshing to work with someone who does what he says he will and truly had our best interest in mind. Thank you for everything.

We would very much appreciate it if you would be so kind as to e-mail to our office the Powerpoint presentation that you made at the commencement of the mediation. Our General Manger was very impressed and would like to show it to the CEO and may in turn show it to other corporate personnel as an example of what can happen to the same or similar case when placed in the hands of an excellent lawyer such as Mark Hartsoe.
